Terms of Service

By creating an account or using Essentia Memoria (the “Platform”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Platform.

These Terms are governed by Turkish law (Türk Borçlar Kanunu) and where applicable, EU law including the Digital Services Act (DSA).

You must be at least 13 years of age to use this Platform. By using the Platform, you represent and warrant that you meet this requirement. Users between 13 and 18 should have parental or guardian consent.

The Platform is not directed to children under 13. We will terminate any account we determine belongs to a child under 13 and delete all associated data.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account at contact@essentiamemoria.com.

You may not create accounts using automated means or under false pretenses. One person may hold one active account unless explicitly permitted otherwise.

You agree NOT to:

• Post content that is harmful, abusive, harassing, threatening, defamatory, or unlawful
• Impersonate any person or entity
• Upload malware, viruses, or any destructive code
• Attempt to gain unauthorized access to any part of the Platform
• Scrape, harvest, or collect user data without permission
• Use the Platform for any commercial purpose without prior written consent
• Violate any applicable law or regulation
• Share content that promotes self-harm or endangers mental health

Essentia Memoria is an emotional tracking and self-reflection platform. It is not a medical service, therapeutic service, or mental health treatment.

The mood tracking, Atlas mapping, and AI features are for personal insight and creative expression only. They are not a substitute for professional psychological or psychiatric care. If you are experiencing a mental health crisis, please contact a qualified mental health professional or crisis hotline immediately.

Paid features are available through subscription plans (Citizen, Guardian, Architect). Subscriptions auto-renew unless cancelled before the renewal date. You can cancel at any time from your account settings.

Refunds are issued at our discretion. If a payment dispute is opened, we reserve the right to suspend the associated account pending resolution.

Prices may change with 30 days' notice to existing subscribers.

The Essentia Memoria Marketplace allows sellers to offer digital, physical, and essence-based products. Sellers are responsible for the accuracy of their listings and compliance with applicable law.

We take a platform commission on each sale as disclosed at the time of seller onboarding. We reserve the right to remove products that violate these Terms or our content guidelines. All products require admin approval before going live.

The Platform is not responsible for disputes between buyers and sellers, though we provide a mediation process.

You retain all rights to content you create and post on the Platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute your content solely for operating the Platform.

The Essentia Memoria name, Atlas system, Generation framework, and all Platform software are our intellectual property. You may not copy, modify, or distribute them without written permission.

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon deletion, a 30-day recovery window applies after which all data is permanently erased.

To the maximum extent permitted by applicable law, Essentia Memoria and its founders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

We will notify you of material changes by email and in-app notification at least 30 days before they take effect. Continued use of the Platform after that period constitutes acceptance.
